CONTRACT AGREEMENT
AGREEMENT: The photographer is responsible for providing for the client a photographic service and products for a photography session. The person(s) whose signature(s) appear on this contract, known as "Client", agree that "North & Oak", shall provide services to photograph their family. The laws of the State of Massachusetts shall govern this contract, and any resulting arbitration shall take place within Boston, Massachusetts. The client assumes responsibility for all collection costs and legal fees incurred by Photographer should enforcement of this contract become necessary.
COOPERATION: The parties agree to cheerful cooperation and communication for the best possible result within the definition of this assignment. In the event the children are uncooperative, we will work with them as best we can. In the event that the child(ren) are uncooperative throughout the duration of the session and no acceptable images are able to be achieved our policy is to reschedule at the photographer’s discretion.
MODEL RELEASE: The client hereby grants to the photographer the unrestricted right to use and publish photographs online in an online gallery or in any marketing form. Clients understand that the images of those photographed, including any minors, may be used in print or on the internet for marketing purposes. The client understands that if images are chosen for marketing purposes, no personal information or names will ever be used.
WEATHER POLICY: In the event of weather conditions out of our control: Due to photography equipment, lighting conditions, and participant safety, it is the photographer’s discretion if weather conditions are such that the session must be rescheduled.
CANCELLATION & RESCHEDULING: If you must cancel, North & Oak must be notified 3 days prior to the session date to qualify for a reschedule. The reschedule date will be made as soon as possible, at the photographer’s discretion. If notification is not made 3 days prior, your session retainer will be forfeited.
LOCATION, ACCESS FEES & PERMITS: If the client chooses a location that charges admission, an access fee, a photography permit, or a parking fee. The client will be responsible to cover those fees associated with shooting at those locations.
DURING YOUR SESSION: Attendance at photo sessions is limited to those being photographed, including siblings. In the case of children and newborns, attendance is limited to two parents only. Please do not bring siblings, personal assistants, nannies, caregivers, or friends not being photographed. Having additional people present can be distracting to both the photographer and to those being photographed. Cameras of any kind are not permitted at our shoot. This includes camera phones. Please arrive on time to your session properly dressed, made up, and ready to begin. Because the session is of a set length, additional time for preparation will reduce the amount of time we can spend in the session and will limit the number of images we can capture.
ADDITIONAL MEMBERS: Sessions are limited to immediate family members. In the event that the client wants to add additional family members/friends in the session, they will be a required $25 fee per person, as well as a signed model release at the time of the session.
ONLINE GALLERY: Images from your session will be placed online or presented in an online gallery within 10-14 days of your session. You are free to share any of your images directly from your online gallery with the provided social media links included on each image. You may not screenshot and post watermarked images. Any photos shared that have been altered by “filters” or creative cropping will be a direct conflict of this contract and must be removed immediately.
PRODUCTS: All printed and tangible products relating to photography coverage must be purchased on the online gallery. Unless specified products are outlined within a collection, purchases must be made through North & Oak within the designated timeline and expiration of the gallery. Product credits expire one year from the session date and prices are subject to change without notice.
PRINT RELEASES: All photographs, digital negatives, and prints are protected by Federal Copyright Law. North & Oak retains the copyright and ownership of all pictures. Digital images will be sent directly to the buyer for download with a print release emailed to the recipient. Print releases will have (one) named representative. Due to federal copyright law, printing with any outsourced third parties will require photo identification of said named person. We do not guarantee or provide support for any outsourced printing.
SOCIAL MEDIA POLICY: Any publishing of downloaded images on social media must include credit to North & Oak, You may do so by captioning a link to the North & Oak website or social media handle or tagging the business. Images that do not credit North & Oak as the photographer violate copyright laws and may be flagged or removed by social media platforms for violating copyright law. We have no control over this. Please credit all images to avoid this.
HEALTH & SAFETY: The client further understands that North & Oak complies with all health and safety laws, directives, and rules and regulations. The client agrees during the session the client or guests shall not carry weapons or firearms, be exposed to severe illness, or request the photographer to do anything illegal or unsafe. Further, North & Oak will not provide services in any location or area deemed to be dangerous in its sole discretion, including, but not limited to, regions affected by infectious diseases, quarantined areas, wildfire, or other similar occurrences. Due to any of these circumstances, North & Oak reserves the right to end service coverage immediately and leave the session.
LIMIT OF LIABILITY: The client agrees that the maximum amount of damages he or she is entitled to in any claim relating to this Agreement or Services provided in this Agreement are not to exceed the Total Cost of Services provided by Provider.
INDEMNIFICATION: Client agrees to indemnify, defend and hold harmless North & Oak its affiliates, employees, agents, and independent contractors for any injury, property damage, liability, claim, or other cause of action arising out of related to Services and product(s) North & Oak provides.
